TERMS AND CONDITIONS

1. Vehicle Condition
   • Express Journeys Car Rental states that to the best of its knowledge and belief the rental vehicle is in sound and safe condition and free of any known defects or faults which would affect its safe operation under normal use.

2. Reservation and Rental Duration
   • Reservations are subject to vehicle availability. Requested periods are not guaranteed without receipt of confirmation or payment of deposit where applicable.
   • The rental period begins and ends at the specified and agreed dates and times. Late returns in excess of 15 mins of the agreed time without prior notice will result in additional charges of $15 BBD per hour or part thereof.
   • Extensions must be requested at least 24 hours in advance and are subject to availability.

3. Driver Requirements
   • Renter must present a valid and in force driver’s license or visitor driver’s permit where applicable.
   • Renter must be at least 25 years of age at the time of rental with a minimum of 2 years driving experience.
   • The Renter agrees that he/she is physically and legally qualified to operate the rental vehicle with due care and attention and according to all traffic Laws of Barbados and that he/she is not aware of any conditions, diagnosed or otherwise which would impair his/he ability to operate the vehicle in a proper and safe manner.
   • During the rental period, the vehicle is to be driven exclusively by the renter or pre-authorized persons meeting the above criteria and declared to Express Journeys. No other person should be granted permission to drive/operate the vehicle.

4. Additional Drivers
   • There will be an additional driver charge of $5 BBD per day per driver. The primary driver’s spouse is exempt from these charges.

5. Payment & Billing
   • A deposit of 50% is due to secure bookings made in excess of 1 week of confirmed rental period.
   • Full payment for the rental period is due on vehicle pickup.
   • Accepted forms of payment include cash or bank transfer (details will be provided on request).
   • The renter agrees to settle all additional charges incurred as a result of damages or any chargeable clause of this agreement within 7 days of invoice or request.

6. Cancellations
   • Cancellations made within 24 hours of the start of rental period may incur a fee of $50.00 Barbados Currency.

7. Refunds
   • Any refunds due to the renter for cancellation of services will be settled within 7 days of cancellation of claim.

8. Vehicle Use & Limitations
   • The rented vehicle shall not be used to carry passengers or property for hire.
   • The rented vehicle shall not be used to carry passengers other than in the interior or cab of the vehicle.
   • The rented vehicle shall not be used to push, propel or tow another vehicle, trailer or any other thing.
   • The rented vehicle shall not be used for any race, pace-making reliability trial, speed testing, off-roading or in any competition.
   • The rented vehicle shall not be used for any illegal purpose.
   • The Renter shall not operate the vehicle in a negligent manner.

9. Insurance and Liability
   • Express Journeys Car Rentals confirms that the vehicle is roadworthy and insured in accordance with the Laws of Barbados.
   • Any accidents which occur while the vehicle is in the possession of the renter must be immediately reported to Express Journeys Car Rentals, the insurer identified by Express Journey Car Rentals and the police (211)
   • In instances where an accident is deemed to be the fault of the renter, the renter may be liable and agrees to settle charges up $1500 BBD to cover insurance excess.
   • The renter bears responsibility for damages, accidents, and theft up to the deductible amount provided by the relevant insurers.

10. Fuel Policy
    • Vehicles will be delivered fueled at full tank capacity.
    • Vehicles should be returned with the same fuel level as at pickup.
    • Vehicles not returned at the same level of fuel will attract a refueling charge of $100 BBD

11. Vehicle Condition on Return
    • The vehicle’s condition will be documented at pickup and return.
    • The renter accepts responsibility for any damage, excessive dirt, and missing items and agrees to cover the costs of any repairs.
    • Cleaning fees of $100 BBD will be applied for vehicles returned in excessively dirty condition.
    • The owners accept no liability for personal items left in the vehicle upon return.

12. Traffic Violations
    • An administrative fee may apply for processing traffic violations.

13. Dispute Resolution
    • In the event of any dispute between the parties relating to the construction of this Agreement or the rights, duties and obligations of the parties or any other matter arising out of ,or, concerning the same the parties shall first use their best endeavours to settle the matter by conciliation and negotiation or mediation where the conciliator or mediator shall be chosen by mutual agreement. Where the chosen and agreed method of settlement fails or the matter is not resolved the parties shall refer the matter to arbitration wherein the appointment of the arbitrator shall be mutually agreed or in accordance with the provisions of the Arbitration Act Chapter 110 of the Laws of Barbados. In the event that the matter is not settled or resolved by arbitration either party shall be entitled to commence action in the Law Courts of Barbados.

14. Privacy and Data Usage
    • Customer data will be used for rental purposes only and stored securely.

15. Governing Law
    • This Agreement is governed by the Laws of Barbados.
